Cox + Cox Mail Order Limited - in Administration (“the Company”)

The Company entered into administration on 27 February 2023 and Ian Defty and Bai Cham, both of Begbies Traynor, were appointed as Joint Administrators. The Joint Administrators are licensed to act as Insolvency Practitioners and as such, are bound by the Insolvency Code of Ethics when carrying out all professional work relating to an insolvency appointment.

The Company's business and certain assets such as the brand, domain names, intellectual property and tangible assets have been bought by the fashion and homeware retailer Giomani Designs Ltd, and outstanding orders received before the purchase will not be fulfilled by the purchaser.

As a consumer creditor, your claim will rank as an unsecured claim in the administration. At present, we believe that the Company has insufficient property to enable a distribution to be made to the unsecured creditors. However, as a consumer creditor, your purchase may be protected under the Consumer Rights Act.

Please be aware that if your order has not arrived before 27 February 2023, it will not be fulfilled. Customers whose products will not be delivered are reminded to check their credit and debit card purchase protection agreements.

As the Company ceased trading, the Joint Administrators are not in a position to accept returns, including faulty goods or exchanges. If you are due a refund for a faulty or returned item - or for an item you had scheduled to return which was purchased prior to the administration, you will be able to register your claim as an unsecured creditor and/or potentially, you may be able to claim funds from the bank or credit card provider. Further details regarding this are detailed below.

You should be aware that whilst in administration the Company has the protection of a wide-ranging moratorium pursuant to the Insolvency Act 1986 (“the Act”). The effect of the moratorium is to prevent any proceedings, execution, distraint, legal action or 'self-help' remedies being commenced or continued against the Company except with our consent or with the permission of the Court.

The Joint Administrators will shortly contact all creditors confirming their appointment and providing further details concerning the Administration and their Proposals.

If you paid with a credit card over £100

If your payment to the Company was made by credit card for the value of £100 or more and you have evidence of the transactions, you may be able to make a claim under Section 75 of the Consumer Credit Act by contacting your card provider to determine if you are eligible to make this claim. They will ask you for copy documents and confirmation that the Company was placed into administration and that there will be no distribution to unsecured creditors. You should shortly receive a formal letter from the Joint Administrators confirming the above, together with the attached Notice of Appointment.

If your credit card provider refuses to refund you, you might make a formal complaint to the Financial Ombudsman Service. For further details, please click here.

If you paid with a debit card or credit card under £100

If your payment to the Company was made using a debit card or credit card under £100 and you have evidence of the transaction, you may be able to make a claim to your bank or card provider under the 'chargeback' scheme. The bank or credit provider will determine if you are eligible to make this claim. They will ask you for copy documents and confirmation that the Company was placed into Administration and that there will be no distribution to unsecured creditors. You should shortly receive a formal letter from the Joint Administrators confirming the above, together with the attached Notice of Appointment. Please note that some banks or credit card providers only allow you to make a claim for purchases not older than 120 days.

PayPal

If payment to the Company was made by PayPal, your purchase may be protected by the 'PayPal Buyer Protection' scheme. In order to request a refund, you must follow PayPal's online dispute resolution process through the Resolution Centre to pursue a claim under our Buyer Protection program. You must open a dispute within 180 days of the date you made the payment.

If you used a credit card or debit card as the payment method for a transaction through your PayPal account and you are dissatisfied with the transaction, you may be entitled to dispute the transaction with your card issuer. Applicable card chargeback rights may be broader than those available to you under PayPal's Buyer Protection program.

Buy Now Pay Later providers (“BNPL”)

If you purchased goods using providers such as Klarna or Clearpay, you should first contact your BNPL provider to check their process and explain the situation.

If your BNPL provider does not resolve the situation, you can ask for a chargeback if you have paid with a credit or debit card.

Unable to obtain a refund from the above

In the event you are not able to obtain a refund using the above options, You can submit your proof of debt form with supporting documents to Martin Brylka of Begbies Traynor at coxcox@btguk.com or by post the documents Begbies Traynor, FAO: Martin Brylka, 31st Floor, 40 Bank Street, London, E14 5NR. Should you wish to complete and return a Proof of Debt Form, you will rank as an unsecured creditor of the Company. Please note that at this stage, we do not anticipate any distribution to unsecured creditors.

In February 2023, Cox & Cox Mail Order Limited was sold as a business and will now trade as Cox & Cox under new company ownership.

Cox & Cox Mail Order Limited went into administration on 27th February 2023 and all company assets were handed over to appointed administrators. Since then, the company has been bought by new owners Giomani Designs Limited.

For orders placed from 28th February 2023

For orders placed on or before 27th February 2023

If your enquiry is regarding an order placed on or before 27th February it will not be fulfilled by the purchaser. You will be able to register your claim as an unsecured creditor and/or potentially, you may be able to claim funds from the bank or credit card provider.
